Are Australia stamps public domain?

Stamps of Australia issued in 1975 or earlier are public domain in 2026, in the archive's reading of Wikimedia Commons. Commons says Australia Post claims copyright in its stamps for 50 years from publication. The cutoff moves forward one year each January, so stamps issued in 1976 become free in 2027.

Why 50 years?

Commons bases its note on Australia Post's own claim of copyright for 50 years from publication, as reported by Caslon Analytics in 2007.1 The same Commons page quotes the Copyright Act 1968 on government works: the Commonwealth or a State owns copyright in works made by it or under its direction, and that copyright lasts until 50 years after the calendar year the work was made.1 Commons accepts stamps published more than 50 years ago under one of its license tags. That tag's table frees photographs and engravings owned by the Commonwealth, a State or a Territory once they were taken or published more than 50 years ago.12

Postal history and copyright

Before federation on January 1, 1901, each of the six Australian colonies ran its own post and issued its own stamps; New South Wales and Victoria were first, in 1850.3 The Commonwealth's Postmaster-General's Department took over the colonial posts in 1901, and the first stamps inscribed for Australia, the Kangaroo and Map series, appeared on January 2, 1913.3 Commons' note names Australia Post and does not say whether it reaches colonial issues; the archive treats that question as open. The archive also applies this rule to three external territories with stamps of their own: Norfolk Island from 1947 to 2016, the Australian Antarctic Territory from 1957 and the Cocos (Keeling) Islands from 1963.3 Commons' note does not name the territories; applying it to them is the archive's reading.

Australia stamps and the public domain: questions

Are Australian stamps public domain?
It depends on the date. In the archive's reading, Australian stamps issued in 1975 or earlier are public domain in 2026, because Australia Post claims copyright in its stamps for 50 years from publication. Stamps issued in 1976 or later are still in copyright.
When do Australian stamps enter the public domain?
Fifty years after publication, counted from the end of the year of issue. Australia Post claims copyright in its stamps for 50 years, so Australian stamps from 1975 or earlier are free in 2026, and each January another year becomes public domain. Stamps issued in 1976 become free in 2027.
Are Norfolk Island, Cocos (Keeling) Islands and Australian Antarctic Territory stamps public domain?
Yes, for stamps issued in 1975 or earlier, in the archive's reading. The archive applies Australia's 50-year rule to Norfolk Island, Cocos (Keeling) Islands and Australian Antarctic Territory stamps, so later issues are still in copyright in 2026. Commons' note on Australian stamps does not name the territories.
