Are Ecuador stamps public domain?

Ecuadorian stamps are public domain 70 years after the year of issue, in the archive's reading of Wikimedia Commons, so stamps issued in 1955 or earlier are free in 2026. Commons finds no exception for stamps in Ecuadorian law and treats them as works owned by a legal person. The cutoff moves forward one year each January.

Why 70 years?

Commons reads Ecuador's Intellectual Property Law, in its 2006 codification, as having no exception for stamps.1 Under that law an employer or commissioning party owns the copyright in works made by its employees or on commission, and a work owned by a legal person from the start is protected for 70 years from its making, disclosure or publication, whichever is later.1 In the archive's reading the 70 years run from the end of the year of issue. Commons' page also says a 2016 code has governed since that year, while its stamp note still cites the earlier law, and that the 1976 law protected works for 50 years after the author's death. It does not say how that older law treated stamps.1 An older Commons list of stamp templates says any Ecuadorian stamp can be uploaded; the archive follows the rules page.2

Copyright law in Ecuador

Ecuador’s own stamps follow the rule below. The historical issuers named here are read under the country’s general copyright law. A design answers Likely yes or Likely no only when every term that could apply agrees, and Unclear when they disagree.

Named designer
70 years after the designer’s death
Anonymous
70 years from issue
Work of the state
70 years from issue
Before 1998
50 years after the designer’s death.
Older stamps
A stamp already in the public domain stayed there when the term was extended.
Note
Stamps get the 70-year term for work held by an organization. That rule comes from the 1998 law, since replaced by the 2016 Organic Code, so the current position is not settled.

Historical issuers read under this law: Galapagos Islands.

Ecuador stamps and the public domain: questions

Are Ecuador stamps public domain?
It depends on the date. In the archive's reading, Ecuadorian stamps are public domain 70 years after the year of issue, so in 2026 that means stamps issued in 1955 or earlier. The cutoff moves forward one year each January.
Are Ecuadorian stamps free of copyright as government works?
No. In the archive's reading, Ecuador's Intellectual Property Law has no exception for stamps, and the copyright in a work made for an employer or on commission belongs to that employer. An Ecuadorian stamp is therefore protected for 70 years, counted from the end of its year of issue.
When does an Ecuadorian stamp enter the public domain?
Seventy years after its year of issue, in the archive's reading. Ecuadorian law protects a work owned by a legal person for 70 years from its making, disclosure or publication, and the archive counts that term from the end of the year of issue. In 2026 that covers stamps issued in 1955 or earlier.
