Are El Salvador stamps public domain?

Stamps of El Salvador are public domain 70 years after the year of issue, in the archive's reading of Wikimedia Commons, so stamps issued in 1955 or earlier are free in 2026. Commons treats stamps as works owned by a legal entity under the Intellectual Property Law of 2024. The cutoff moves forward one year each January.

Why 70 years?

Commons reads Article 90(c) of El Salvador's Intellectual Property Law of 2024, carried over from the 2017 law, as protecting works owned by legal entities for 70 years counted from January 1 of the year after first publication.1 The archive applies that term to every stamp. Commons adds that the 1993 law gave 50 years and the 2017 amendment raised the term to 70; it does not say whether the longer term reached works whose 50 years had already run out.1 In an email of January 11, 2007, the head of the government's Philatelic Office allowed non-commercial educational, philatelic and cultural use of stamp images, and Commons does not accept images under that restriction.1 An older Commons list of stamp templates says any Salvadoran stamp can be uploaded; the archive follows the rules page.2

El Salvador stamps and the public domain: questions

Are El Salvador stamps public domain?
Yes, for older issues. In the archive's reading, Salvadoran stamps are protected as works owned by a legal entity for 70 years from January 1 after the year of issue, so stamps issued in 1955 or earlier are public domain in 2026. The cutoff moves forward one year each January.
Can I use Salvadoran stamps for non-commercial purposes?
Yes, for some purposes. In an email of January 11, 2007, the head of El Salvador's Philatelic Office allowed non-commercial educational, philatelic and cultural use of stamp images. Wikimedia Commons does not accept images under that restriction, and in the archive's reading only stamps issued in 1955 or earlier are public domain in 2026.
Did El Salvador's copyright term change?
Yes. El Salvador's 1993 law protected works owned by legal entities for 50 years, and a 2017 amendment raised the term to 70, which the Intellectual Property Law of 2024 carries over. Whether the longer term revived protection that had already ended is an open question, and the archive applies 70 years to every Salvadoran stamp.
