Are Ireland stamps public domain?
Irish stamps issued in 1975 or earlier are public domain in 2026, in the archive's reading of Wikimedia Commons, and the line moves forward a year each January. Commons treats stamps of the Department of Posts and Telegraphs as government works, free 50 years after the year of issue. Stamps issued by An Post since 1984 are copyrighted.
Why 1975?
Ireland's Copyright and Related Rights Act, 2000 makes the government the first owner of work made by its officers and employees, and ends that copyright 50 years from the end of the calendar year in which the work was made.1 Commons treats stamps issued by the Department of Posts and Telegraphs as such official works and counts them free when published before January 1, 1976, a date its page moves forward each year. A stamp from 1975 was protected through December 31, 2025.1 Commons' license tag for these stamps covers work made by state officers or employees in the course of their duties and created more than 50 years ago.2 The rule stops at 1984, when An Post was established and, Commons says, became the copyright owner of Irish stamps.1 Commons also asks that an Irish file be free in the United States, and its note on stamps does not address American status.1
Postal history and copyright
Ireland used British stamps from 1840 until the new Irish government took power in 1922.3 From February 17, 1922, British stamps of King George V were overprinted in Irish, first for the Provisional Government and then for the Irish Free State, and the first Irish designs, led by a 2d map of the island, were issued on December 6, 1922.3 The last overprints, on British high values, were made in 1937.3 The Department of Posts and Telegraphs issued every Irish stamp from 1922 to 1983, and An Post has issued them since 1984.3 Commons' note on Irish stamps does not say whether the British designs under the overprints of 1922 to 1937 follow Irish or British law, and the archive treats that question as open.

Ireland stamps and the public domain: questions
- Are Irish stamps public domain?
- It depends on the date. In the archive's reading, Irish stamps issued in 1975 or earlier are public domain in 2026 as government works, free 50 years after the year of issue, and the line moves forward a year each January. Stamps issued by An Post since 1984 are copyrighted.
- Are An Post stamps copyrighted?
- Yes. An Post has owned the copyright in Irish stamps since January 1, 1984, and no date is given on which that copyright ends. The 50-year rule for government works covers only stamps of the Department of Posts and Telegraphs, issued from 1922 to 1983.
- When will Irish stamps from 1983 be public domain?
- On January 1, 2034, in the archive's reading. Irish stamps from the Department of Posts and Telegraphs are government works, free on January 1 of the 51st year after their year of issue, and 1983 was the department's last year of issuing stamps. Stamps issued by An Post from 1984 on fall outside that rule.
- Are the 1922 Irish overprints public domain?
- It is an open question. From 1922 to 1937 British stamps of King George V were overprinted in Irish, and Wikimedia Commons' note on Irish stamps does not say whether the British designs under those overprints follow Irish or British law.
