Are Kenya stamps public domain?
Kenyan stamps issued in 1975 or earlier are public domain in 2026, in the archive's reading of Wikimedia Commons, and the line moves forward a year each January. Commons treats Kenyan stamps as works commissioned by the government, protected for 50 years after the year of publication, and reads colonial issues under British Crown copyright.
Why 1975?
Commons quotes Kenya's Copyright Act of 1966: a work made on commission from the government is protected until 50 years from the end of the year it was first published, and the Copyright Act of 2001 keeps that term in section 25(2).1 Commons counts stamps published before January 1, 1976 as free, a date its page moves forward each year, and tags them under its Kenyan license tag, with the option for anonymous works published more than 50 years ago.12 For stamps from before December 1965 it points instead to its tag for British government works published more than 50 years ago.13 Both tags count 50 years from publication; a stamp from 1975 was protected through December 31, 2025.
Postal history and copyright
Before independence, Kenya used the stamps of British East Africa, of the East Africa and Uganda Protectorates, of Kenya and Uganda from 1922, and of Kenya, Uganda and Tanganyika from 1935.4 Independent Kenya issued its first stamps on December 12, 1963, and its stamps were valid in Uganda and Tanzania until 1976.4 The archive applies the Kenyan rule to the joint Kenya and Uganda and Kenya, Uganda and Tanganyika issues as well. Commons places the change from Crown copyright at December 1965, two years after independence, without saying why,1 and it does not say whether Kenyan, Ugandan, Tanzanian or British law governs the joint issues. The archive treats that question as open.

- Work of the state
- 50 years from issue
- Note
- Stamps take the 50-year term for work commissioned by the government. The law was amended in 2019, and these terms may not reflect it.

Kenya stamps and the public domain: questions
- Are Kenyan stamps public domain?
- It depends on the date. In the archive's reading, Kenyan stamps issued in 1975 or earlier are public domain in 2026, because Kenya protects works commissioned by the government for 50 years after the year of publication. The line moves forward a year each January.
- Are Kenya, Uganda and Tanganyika stamps public domain?
- Yes, for issues from 1975 or earlier, in the archive's reading, which applies Kenya's 50-year rule to the joint Kenya, Uganda and Tanganyika stamps. Wikimedia Commons does not say whether Kenyan, Ugandan, Tanzanian or British law governs the joint issues, so that question is open.
- Are Kenyan colonial stamps public domain?
- Yes, in the archive's reading. Kenyan stamps from before December 1965 are read under British Crown copyright, which also ends 50 years after publication, so the colonial issues are now public domain.
- Will the 1975 cutoff for Kenyan stamps change?
- Yes. In the archive's reading, Kenyan stamps are public domain 50 years after the end of their year of publication, so the cutoff moves forward one year each January as another year of issues passes 50 years.
