Are Malawi stamps public domain?
It depends on the date: Malawian stamps issued in 1975 or earlier are public domain in 2026, in the archive's reading of Wikimedia Commons. Commons marks Malawian stamps copyrighted under the Copyright Act 2016, which protects government works for 50 years from first publication. The cutoff moves forward one year each January.
Why 1975?
Section 35(1)(e) of Malawi's Copyright Act 2016 protects a work owned by the government for 50 years from first publication, and every term runs to the end of the calendar year.1 In the archive's reading every Malawian stamp is a government work, so a stamp issued in 1975 was protected through December 31, 2025. Commons adds that works by individual authors get the author's life plus 50 years, and that the first Malawi stamps, from July 6, 1964, could have been free in 2015 at the earliest, and then only if their artwork is a government work.1 Commons says the 2016 act appears to apply to older works, as the 1989 act it replaced did. Its note on stamps does not address status in the United States, where Commons also requires a file to be free.1
Postal history and copyright
The region west and south of Lake Nyasa became the British protectorate of Nyasaland, joined the Federation of Rhodesia and Nyasaland in 1953, and became independent in 1964, according to Commons.1 Stamps were issued for the British Central Africa Protectorate from 1891, for Nyasaland from 1908 and for the Federation from 1954, and Malawi's own first stamps appeared on July 6, 1964, according to Wikipedia.2 Commons' note on stamps begins with the 1964 issues. It does not say which law governs the earlier protectorate and federation stamps, and the archive treats that question as open.

Malawi stamps and the public domain: questions
- Are Malawi stamps public domain?
- It depends on the date. In the archive's reading, Malawian stamps are government works protected for 50 years from first publication, so those issued in 1975 or earlier are public domain in 2026. The line moves forward one year each January.
- When did the first Malawi stamps become public domain?
- In 2015 at the earliest. Malawi's first stamps, issued on July 6, 1964, could have become free that year only if their artwork is a government work, protected for 50 years from first publication. The archive treats every Malawian stamp as a government work.
- Are Nyasaland stamps public domain?
- It is an open question. Stamps were issued for the British Central Africa Protectorate from 1891, for Nyasaland from 1908 and for the Federation of Rhodesia and Nyasaland from 1954, but Wikimedia Commons' note on Malawian stamps begins with the 1964 issues and does not say which law governs the earlier ones.
- What if a Malawi stamp has a named designer?
- In the archive's reading, the 50-year term for government works, counted from first publication, still applies to every Malawian stamp. Malawi's Copyright Act 2016 protects works by individual authors for the author's life plus 50 years, but the archive treats each stamp as a government work.
