Are South Africa stamps public domain?
South African stamps issued in 1975 or earlier are public domain in 2026, in the archive's reading of Wikimedia Commons, which treats them as government works protected for 50 years from publication. The line moves forward one year each January, so stamps of 1976 become free on January 1, 2027.
Why 1975?
Section 5(3) of South Africa's Copyright Act 1978 ends copyright in a literary, musical or artistic work made by the government 50 years after the end of the year it was first published.1 Commons' stamp note applies that term with a license tag that covers government works published more than 50 years ago; in 2026 the note reads published before January 1, 1976.12 Commons also requires a South African file to be free in the United States, and its stamp note does not address American status.1
Postal history and copyright
Before the Union of South Africa was formed on May 31, 1910, its parts issued their own stamps: the Cape of Good Hope from 1853, Natal from 1857, the Orange Free State from 1868 and the South African Republic (Transvaal) from 1869, among others.13 The Union's first stamp appeared on November 4, 1910, and the Republic of South Africa issued its first set on May 31, 1961. From 1976 to 1994 the homelands of Transkei, Bophuthatswana, Venda and Ciskei also issued stamps.3 Commons' note speaks only of South African stamps and does not say whether issues of the earlier colonies and republics, or of the homelands, are works of the South African government.1 The archive applies the South African rule to the South African Republic, whose stamps all date from before 1900. The status of the homeland issues is an open question.

Copyright law in South Africa
South Africa’s own stamps follow the rule below. The historical issuers named here are read under the country’s general copyright law. A design answers Likely yes or Likely no only when every term that could apply agrees, and Unclear when they disagree.
- Named designer
- 50 years after the designer’s death
- Anonymous
- 50 years from issue
- Work of the state
- 50 years from issue
- Note
- A published artistic work expires 50 years after first publication; life plus 50 applies only to unpublished work. South African stamps older than 50 years are public domain.
Historical issuers read under this law: Bophutatswana, British Bechuanaland, Cape of Good Hope, Ciskei, Griqualand West, Lydenburg, Mafeking, Natal, New Republic, Orange Free State, Orange River Colony, Pietersburg, Rustenburg, Schweizer-Renecke, Stellaland Republic, Transkei, Transvaal, Venda, Volksrust, Vryburg, Wolmaransstad, Zululand.

South Africa stamps and the public domain: questions
- Are South African stamps public domain?
- It depends on the date. In the archive's reading, South African stamps issued in 1975 or earlier are public domain in 2026, as government works protected for 50 years after the end of the year of publication. The line moves forward one year each January.
- When do South African stamps become public domain?
- On January 1 of the 51st year after the year of issue, in the archive's reading. Section 5(3) of South Africa's Copyright Act 1978 ends copyright in government works 50 years after the end of the year of first publication. A South African stamp of 1976 therefore becomes free on January 1, 2027.
- Are Transvaal stamps public domain?
- Yes, in the archive's reading. The archive applies the South African rule to stamps of the South African Republic (Transvaal), issued from 1869 and all dating from before 1900, so their 50-year term has run out. Commons' note does not say whether these stamps are works of the South African government.
- Are Transkei or Bophuthatswana stamps public domain?
- The question is open. Transkei, Bophuthatswana, Venda and Ciskei issued stamps from 1976 to 1994, and Commons' note covers only South African stamps. It does not say whether these homeland issues are works of the South African government.
