Copyright and fair use information for postage stamps

Are Tajikistan stamps public domain?

Yes: Tajikistan's stamps are public domain whatever their date, in the archive's reading of Wikimedia Commons. Commons cites Tajik copyright law, which leaves state symbols and signs unprotected, and the 2003 postal law, which defines stamps as state signs of payment for postal services. Commons accepts them under one of its license tags, and the archive applies no cutoff.

Why any date?

Article 7 of Tajikistan's Law on Copyright and Related Rights lists material copyright does not cover, among it state symbols and signs; Commons' summary names the flag, coat of arms, anthem and national currency.1 Commons quotes the Law on Postal Services of June 4, 2003, which defines postage stamps, blocks, stamped envelopes and postal cards as state signs of payment for postal services.1 Commons reads the two laws together and accepts stamps under one of its license tags.1 That tag quotes the earlier copyright law, No. 726 of November 13, 1998, and says it also covers official symbols of the Tajik Soviet Socialist Republic, since Tajikistan is its legal successor.2 Commons gives no term or cutoff year for stamps.1

Postal history and copyright

Tajikistan became a Soviet republic in 1929 and fully independent on September 9, 1991.1 It used Soviet stamps until its first stamp appeared on May 20, 1992.3 The Tajik post then overprinted Soviet stamps as its own supplies ran short; English Wikipedia dates this to 1992 and 1993.3 Russian Wikipedia lists overprints from 1992 to 1997, on Soviet stamps and on Tajikistan's own.4 Commons' note does not address the Soviet designs under those overprints, or say how the 2003 postal law bears on stamps issued before it. The tag's note on Tajik SSR symbols does not mention stamps.2

Tajikistan stamps and the public domain: questions

Are Tajikistan stamps public domain?
Yes. In the archive's reading, Tajik copyright law leaves state symbols and signs unprotected, and Tajikistan's 2003 postal law defines stamps as state signs of payment for postal services. Tajikistan stamps of any date are therefore public domain, with no cutoff year.
Why are Tajik stamps not copyrighted?
Because Tajik law treats stamps as state signs. Article 7 of Tajikistan's Law on Copyright and Related Rights excludes state symbols and signs from copyright, and the Law on Postal Services of June 4, 2003 defines postage stamps as state signs of payment for postal services. Read together, the two laws leave Tajik stamps of any date unprotected.
Does this cover Soviet stamps used in Tajikistan?
It is an open question. Tajikistan used Soviet stamps until its first stamp appeared on May 20, 1992, and then overprinted Soviet stamps as its own supplies ran short. Commons' note on Tajik stamps does not address Soviet stamps or the Soviet designs under those overprints.
