Are United Kingdom stamps public domain?
It depends on the date: United Kingdom stamps whose designs were published before October 1, 1969 are public domain, in the archive's reading of Wikimedia Commons, because their Crown copyright lasted 50 years and has run out. Commons says later British stamps are copyright of the Post Office or Royal Mail, and the archive marks them copyrighted.
Why October 1, 1969?
Commons says British stamp designs published before October 1, 1969 were Crown copyright, which lasted 50 years and has expired.1 The Post Office Act 1969 changed the General Post Office from a department of state into a public corporation, and John Stonehouse became the first Minister of Posts and Telecommunications on October 1, 1969.2 Commons says the Post Office was then set up as a non-Crown body, and that since then the Post Office or Royal Mail has held the copyright in new British stamps in its own right, so in general Commons accepts no later stamp.1 Its license tag for expired Crown copyright covers works published more than 50 years before the current year.3 For a stamp known only by its year, 1969 falls on both sides of the line, so the archive's cutoff reads 1968 or earlier.
Postal history and copyright
Britain introduced postage stamps in 1840.4 Commons says the pre-1969 Crown copyright rule also covers stamps of territories of the British Empire before their independence.1 Gibraltar, the Pitcairn Islands and the British Indian Ocean Territory are British Overseas Territories, and Commons' pages for all three send stamp questions to the British note.567 Gibraltar has issued its own stamps since 1886, now through the Royal Gibraltar Post Office, and the Pitcairn Islands since 1940.89 The British note speaks of the Post Office and Royal Mail and does not say who holds the copyright in stamps those territories issued after 1969. The archive applies the British rule to all three.

United Kingdom stamps and the public domain: questions
- Are British stamps public domain?
- It depends on the date. In the archive's reading, United Kingdom stamps whose designs were published before October 1, 1969 are public domain, because their 50-year Crown copyright has run out. Later stamps belong to the Post Office or Royal Mail and are copyrighted.
- Are Royal Mail stamps copyrighted?
- Yes, for stamps issued since October 1, 1969. That year the Post Office became a non-Crown body, and since then the Post Office or Royal Mail has held the copyright in new British stamps in its own right. Earlier designs were Crown copyright, which lasted 50 years and has expired.
- Are 1969 British stamps public domain?
- Only those whose designs were published before October 1, 1969, when British stamp designs stopped being Crown copyright. For a stamp known only by its year, 1969 falls on both sides of the line, so the archive's cutoff reads 1968 or earlier.
- Are Gibraltar or Pitcairn Islands stamps public domain?
- In part. The archive applies the British rule to Gibraltar and the Pitcairn Islands, so designs published before October 1, 1969 are public domain and later ones are marked copyrighted. Wikimedia Commons does not say who holds the copyright in stamps those territories issued after 1969.
